Terms of Service for Heard It Too

Heard It Too is a citizen-science tool for tracking how information spreads geographically and over time. Users post things they’ve heard (“contributions”), confirm contributions others have posted (“I’ve heard this too” or “HIT” ), and view a map showing where a contribution originated and where it’s been confirmed.

Heard It Too does not verify the accuracy of any contribution. Contributions reflect what a user reports having heard — not a confirmed fact, and not a claim by Heard It Too that the content is true. Use judgment when interpreting anything you see on the App.

You must be at least 13 years old to use Heard It Too. By using the App, you represent that you meet this requirement.

• You’re responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You agree to provide accurate information when creating your account (including a real home ZIP code, which is used for the App’s core spread-tracking features).
• You may not create an account on behalf of someone else, or create multiple accounts to manipulate confirmations, flags, or trending content.
• We may suspend or terminate your account if we believe you’ve violated these Terms.

Ownership.

You retain ownership of any contribution, confirmation, or other content you post to Heard It Too.

License to us.

By posting content, you grant Heard It Too a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content within the App, and to use aggregated or de-identified versions of it (for example, to analyze or share general spread-trend patterns) as described in our Privacy Policy.

Your responsibility.

You are solely responsible for the content you post. You agree not to post content that:

• Is unlawful, defamatory, harassing, or threatening
• Infringes someone else’s intellectual property or privacy rights
• Is spam, or is posted to manipulate the App’s confirmation, trending, or duplicate-detection systems
• Impersonates another person or entity
• Is intended to incite violence or hatred against any individual or group

Any user can flag a contribution they believe violates these Terms or is otherwise inappropriate. We may remove flagged content, or any content, at our discretion, without prior notice. We may also suspend or terminate accounts that repeatedly post content requiring removal.

We are not obligated to remove content simply because it is disputed, unpopular, or unflattering — only where it violates these Terms or applicable law.

You agree not to:

• Use automated means (bots, scrapers) to access or interact with the App without our permission
• Attempt to gain unauthorized access to other accounts, our systems, or data
• Interfere with or disrupt the App’s functionality
• Use the App for any purpose that violates applicable law

The Heard It Too name, logo, and the App’s design, features, and underlying code are owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you rights to our trademarks, branding, or proprietary technology, except the limited right to use the App as intended.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT POSTED BY USERS IS ACCURATE OR RELIABLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, HEARD IT TOO AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY CONTENT POSTED BY USERS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold harmless Heard It Too and its operator from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the App, your content, or your violation of these Terms.

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App at our discretion, including for violation of these Terms, without prior notice.

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify users directly. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles.
